These Terms of Service (“Terms”) form a legally binding agreement between you (“Learner”, “Customer”, “you”) and BBSB DEVELOPMENT CO., LTD., company registration no. 0105568225353, 357 Soi Vibhavadi Rangsit 42, Lat Yao Subdistrict, Chatuchak District, Bangkok 10900 (“BBSB”, “we”, “us”).
By accessing wordsbird.com (the “Site”) or purchasing any Course, you confirm that you have read, understood, and agree to be bound by (i) these Terms, (ii) our Privacy Policy, and (iii) our Refund Policy (collectively the “Agreement”). If you do not agree, do not use the Service.
“Service” – the online platform through which Wordsbird provides paid and free digital educational content, including on-demand video courses, live webinars, downloadable materials, quizzes, and certificates of completion.
“Course” – a specific bundle of educational content and related resources offered for a stated price.
“Order” – your purchase of a Course through the checkout on the Site.
“Digital Content” – any files, recordings, or documents delivered electronically as part of a Course.
2.1 Wordsbird provides educational content for informational and self-development purposes only. We do not provide legal, financial, medical, or professional advice, nor do our Courses constitute accredited academic programmes unless explicitly stated.
2.2 Completion certificates reflect only that you completed internal assessments and do not carry governmental or academic accreditation unless expressly indicated.
2.3 The Service is available to both consumers and business customers. Where you act as a consumer, nothing in these Terms restricts the mandatory rights granted under Thai consumer-protection law, including the Consumer Protection Act B.E. 2522.
2.4 We may refuse or remove content that is unlawful, harmful, defamatory, infringes intellectual-property rights, or violates these Terms.
3.1 Course descriptions and prices on the Site are an invitation to treat. Your Order becomes binding once we email a confirmation.
3.2 All prices are listed in US Dollars (USD) and include all applicable taxes unless stated otherwise.
3.3 Payment is due in full at checkout via the supported payment gateways. We do not store complete payment-card details; see our Privacy Policy for data-handling information.
3.4 Because Digital Content is delivered immediately after purchase, you acknowledge and agree that once access to the Course is provided, the Order is final and non-revocable, except where required under Thai law or under our Refund Policy.
4.1 Courses are delivered online through your Wordsbird account dashboard. Access is granted immediately after successful payment.
4.2 We aim for 24/7 availability but do not guarantee uninterrupted access. Planned maintenance will be announced where practicable.
4.3 You are responsible for ensuring device compatibility and a stable internet connection.
5.1 Upon full payment, BBSB grants you a non-exclusive, non-transferable, revocable licence to access and use the Course materials for personal learning or internal business training.
5.2 You may not share, resell, record, copy, distribute, or publicly display Course content without prior written consent.
5.3 All intellectual-property rights in the Service — including videos, slides, documents, code, trademarks, and brand names — remain owned by BBSB and its content providers.
You agree to:
(a) Provide accurate account information and keep login credentials confidential;
(b) Use the Service only as permitted and not attempt to reverse-engineer, disrupt, or scrape the platform;
(c) Refrain from uploading malware or unlawful content;
(d) Comply with applicable Thai laws, including export controls, sanctions, and the Personal Data Protection Act (PDPA).
7.1 We strive for high-quality, up-to-date content created by subject-matter experts, but we do not warrant that all information is complete, error-free, or current at all times.
7.2 Minor updates or corrections may be applied without additional cost. Major new editions may be sold separately.
8.1 Our Refund Policy explains the conditions for refunds. Generally, refunds are only possible if you have not accessed the Digital Content.
8.2 If Digital Content is materially defective (e.g., missing modules, corrupted files), notify us within 14 days. We will repair, replace, or refund as appropriate.
8.3 Subscription services (if offered) may be cancelled at any time, but access continues until the end of the current billing period.
9.1 Prices shown normally include Thai VAT, where applicable.
9.2 For customers outside Thailand, taxes may or may not apply depending on your billing location and local tax regulations.
9.3 For Thai business customers who provide a valid tax ID, VAT invoices may be issued in accordance with Thai revenue regulations.
We process personal data in accordance with the Thai PDPA (Personal Data Protection Act B.E. 2562) and the Wordsbird Privacy Policy, which explains data categories, purposes, and retention. The Site uses essential cookies and, where applicable, optional analytics cookies subject to your consent.
11.1 Courses are provided “as is” for educational purposes and do not replace professional advice.
11.2 To the maximum extent permitted by law, BBSB is not liable for indirect or consequential losses, including loss of profit, business opportunities, or data.
11.3 BBSB’s total liability for any claim under an Order is capped at the amount you paid for that Order.
11.4 Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited under Thai law.
Neither party is liable for delays or failures caused by events beyond reasonable control, including natural disasters, war, government action, or major internet outages. Payment obligations are excluded from force-majeure relief.
We may revise these Terms by posting an updated version on the Site. Material changes will be notified at least 14 days in advance. Continued use of the Service after the effective date constitutes acceptance.
These Terms are governed by the laws of the Kingdom of Thailand.
Any dispute not resolved amicably shall be submitted to the jurisdiction of the Thai courts.
Consumers may also submit complaints to the relevant Thai consumer-protection authorities.
If any part of these Terms is held unenforceable, the remaining provisions remain in effect. Headings are for convenience only.
ข้อกำหนดในการใช้บริการฉบับนี้ (“ข้อกำหนด”) เป็นสัญญาที่มีผลผูกพันตามกฎหมายระหว่างคุณ (“ผู้เรียน”, “ลูกค้า”) กับ บริษัท บีบีเอสบี ดีเวลลอปเมนท์ จำกัด เลขทะเบียนนิติบุคคล 0105568225353 ที่อยู่ 357 ซอยวิภาวดีรังสิต 42 แขวงลาดยาว เขตจตุจักร กรุงเทพมหานคร 10900 (“บริษัท”, “เรา”).

“หลักสูตร (Course)” — ชุดเนื้อหาและทรัพยากรการเรียนรู้ที่จัดจำหน่ายในราคาที่ระบุ
“คำสั่งซื้อ (Order)” — การซื้อหลักสูตรผ่านระบบชำระเงินบนเว็บไซต์
“เนื้อหาดิจิทัล (Digital Content)” — ไฟล์ บันทึกเสียง/ภาพ เอกสาร หรือสื่ออิเล็กทรอนิกส์ที่เป็นส่วนหนึ่งของหลักสูตร
2.1 Wordsbird ให้บริการเพื่อการพัฒนาตนเองเท่านั้น ไม่ให้คำแนะนำด้านกฎหมาย การเงิน การแพทย์ หรือคำปรึกษาวิชาชีพ และไม่ถือเป็นหลักสูตรที่ได้รับการรับรองจากสถาบันหรือภาครัฐ เว้นแต่จะระบุไว้โดยชัดแจ้ง
2.2 ใบรับรองการเรียนจบเป็นเพียงหลักฐานว่าคุณได้เรียนหรือทำแบบทดสอบภายในระบบ ไม่ใช่วุฒิการศึกษาที่มีผลทางราชการ เว้นแต่จะระบุว่าได้รับการรับรอง
2.3 บริการนี้ให้แก่ผู้บริโภคและลูกค้าธุรกิจ โดยสิทธิของผู้บริโภคภายใต้ พระราชบัญญัติคุ้มครองผู้บริโภค พ.ศ. 2522 ยังคงมีผลสมบูรณ์และไม่จำกัดด้วยเงื่อนไขในข้อกำหนดนี้
2.4 บริษัทอาจปฏิเสธหรือลบเนื้อหาที่ผิดกฎหมาย เป็นอันตราย หมิ่นประมาท ละเมิดลิขสิทธิ์ หรือขัดต่อข้อกำหนดนี้ได้
3.1 รายละเอียดและราคาหลักสูตรบนเว็บไซต์เป็นเพียงคำเชิญให้เสนอซื้อ คำสั่งซื้อมีผลผูกพันเมื่อบริษัทส่งอีเมลยืนยัน
3.2 ราคาทั้งหมดแสดงเป็น บาทไทย (THB) และรวมภาษีที่เกี่ยวข้องแล้ว เว้นแต่ระบุเป็นอย่างอื่น
3.3 ต้องชำระเงินเต็มจำนวนเมื่อสั่งซื้อผ่านช่องทางที่รองรับ บริษัทไม่เก็บข้อมูลบัตรเต็มรูปแบบ (ดูนโยบายความเป็นส่วนตัว)
3.4 เนื่องจากเนื้อหาดิจิทัลถูกส่งมอบทันทีหลังการชำระเงิน คุณรับทราบและยินยอมว่าคำสั่งซื้อไม่สามารถยกเลิกหรือขอคืนได้หลังจากได้รับสิทธิ์เข้าถึง เว้นแต่ตามกฎหมายไทยหรือเงื่อนไขในนโยบายการคืนเงิน
4.1 หลักสูตรส่งมอบผ่านบัญชี Wordsbird ของคุณทันทีหลังการชำระเงิน
4.2 บริษัทพยายามให้บริการได้ตลอด 24 ชั่วโมง แต่ไม่รับประกันความต่อเนื่องของระบบ
4.3 ผู้ใช้ต้องจัดหาอุปกรณ์และอินเทอร์เน็ตที่เหมาะสมด้วยตนเอง
5.1 เมื่อชำระเงินครบถ้วน คุณได้รับสิทธิใช้งานเนื้อหาหลักสูตรแบบไม่ผูกขาด ไม่โอนสิทธิ และอาจเพิกถอน เพื่อใช้ในการเรียนรู้ส่วนบุคคลหรือฝึกอบรมภายในองค์กรเท่านั้น
5.2 ห้ามแชร์ จำหน่ายซ้ำ บันทึก คัดลอก เผยแพร่ หรือแจกจ่ายเนื้อหาโดยไม่ได้รับอนุญาตเป็นลายลักษณ์อักษร
5.3 สิทธิในทรัพย์สินทางปัญญาทั้งหมดในบริการเป็นของบริษัทและผู้ให้เนื้อหา
คุณตกลงที่จะ:
(a) ให้ข้อมูลบัญชีที่ถูกต้องและเก็บรักษารหัสผ่านอย่างปลอดภัย
(b) ใช้บริการตามที่อนุญาต ไม่พยายามรบกวน แกะรหัส หรือดึงข้อมูลโดยวิธีที่ผิดปกติ
(c) ไม่อัปโหลดไฟล์ที่มีอันตรายหรือผิดกฎหมาย
(d) ปฏิบัติตามกฎหมายไทยที่เกี่ยวข้อง รวมถึงกฎหมายคุ้มครองข้อมูลส่วนบุคคล (PDPA)
7.1 บริษัทมุ่งจัดทำเนื้อหาที่มีคุณภาพและทันสมัย แต่ไม่รับประกันว่าปราศจากข้อผิดพลาดหรือครบถ้วนทุกประการ
7.2 การแก้ไขหรืออัปเดตเล็กน้อยทำได้โดยไม่คิดค่าใช้จ่าย ส่วนหลักสูตรรุ่นใหม่อาจจำหน่ายแยกต่างหาก
8.1 นโยบายการคืนเงินกำหนดเงื่อนไขที่สามารถคืนเงินได้ โดยทั่วไปจะคืนได้เมื่อคุณยัง ไม่ได้เข้าถึง เนื้อหาดิจิทัล
8.2 หากเนื้อหาดิจิทัลบกพร่องอย่างมีนัยสำคัญ เช่น ไฟล์เสีย หรือโมดูลหาย กรุณาแจ้งภายใน 14 วัน บริษัทจะซ่อมแทน เปลี่ยน หรือคืนเงินตามความเหมาะสม
8.3 บริการแบบสมัครสมาชิก (ถ้ามี) สามารถยกเลิกได้ตลอดเวลา และยังใช้งานได้จนถึงสิ้นสุดรอบบิลปัจจุบัน
9.1 ราคามักรวม ภาษีมูลค่าเพิ่ม (VAT) ของประเทศไทยแล้ว
9.2 ลูกค้าที่อยู่นอกประเทศไทยอาจมีภาษีที่แตกต่างตามข้อบังคับท้องถิ่น
9.3 ลูกค้าธุรกิจที่ให้เลขประจำตัวผู้เสียภาษีถูกต้องสามารถขอใบกำกับภาษีตามกฎหมายไทยได้
บริษัทประมวลผลข้อมูลส่วนบุคคลตาม พระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 และนโยบายความเป็นส่วนตัว เว็บไซต์ใช้คุกกี้ที่จำเป็น รวมถึงคุกกี้วิเคราะห์เมื่อได้รับความยินยอม
11.1 หลักสูตรให้ “ตามสภาพที่เป็น” เพื่อการศึกษาเท่านั้น ไม่ใช่คำแนะนำวิชาชีพ
11.2 บริษัทไม่รับผิดชอบต่อความเสียหายทางอ้อมหรือความเสียหายต่อธุรกิจหรือข้อมูล
11.3 ความรับผิดสูงสุดของบริษัทจำกัดไม่เกินจำนวนเงินที่คุณชำระสำหรับคำสั่งซื้อนั้น
11.4 ข้อกำหนดนี้ไม่จำกัดความรับผิดกรณีการเสียชีวิต บาดเจ็บจากความประมาทเลินเล่อ การฉ้อโกง หรือความรับผิดที่กฎหมายไทยห้ามจำกัด
ฝ่ายใดฝ่ายหนึ่งไม่ต้องรับผิดเมื่อไม่สามารถปฏิบัติหน้าที่ได้เนื่องจากเหตุสุดวิสัย เช่น ภัยธรรมชาติ สงคราม การสั่งการของรัฐ หรือเหตุขัดข้องระบบอินเทอร์เน็ต (เว้นแต่เป็นภาระการชำระเงิน)
บริษัทอาจปรับปรุงข้อกำหนดโดยประกาศบนเว็บไซต์ หากเป็นการเปลี่ยนแปลงสำคัญจะมีการแจ้งล่วงหน้าอย่างน้อย 14 วัน การใช้งานบริการต่อไปถือว่ายอมรับการแก้ไข
ข้อกำหนดนี้อยู่ภายใต้ กฎหมายแห่งราชอาณาจักรไทย
หากมีข้อพิพาทไม่สามารถตกลงกันได้ ให้ยื่นต่อศาลไทยตามเขตอำนาจ ผู้บริโภคสามารถร้องเรียนต่อหน่วยงานคุ้มครองผู้บริโภคได้เช่นกัน
หากข้อใดใช้ไม่ได้ ข้ออื่นยังมีผลสมบูรณ์ หัวข้อใช้เพื่อความสะดวกในการอ่านเท่านั้น
